Excusing Federal Employees on Mond=
ay, December 24, 2012

The President has issued an Executive order excusing executive branch =
non-Postal Service employees from duty on Monday, December 24, 2012, exce=
pt those who, in the judgment of the head of the agency, cannot be excuse=
d for reasons of national security, defense, or other essential public ne=
ed. (See Attachment 1.) For pay and leave purposes, December 24, 2012, =
will be treated as falling within the scope of statutes and Executive ord=
ers governing holidays for Federal employees.

Most employees w=
ho are excused from duty on December 24th will receive the basic pay they=
would have received if no Executive order had been issued. An employee =
who was previously scheduled to take annual leave on December 24th will n=
ot be charged annual leave (or any other form of paid leave, compensatory=
time off, or credit hours). (This policy does not apply to employees wh=
o receive annual premium pay for standby duty under 5 U.S.C. 5545(c)(1) o=
r to firefighters who are covered by the special pay provisions of 5 U.S.=
C. 5545b.) An employee who is required to work nonovertime hours on Dece=
mber 24th is entitled to holiday premium pay under 5 U.S.C. 5546(b).

If an employee has scheduled “use or lose” annual leav=
e for December 24, 2012, and is unable to reschedule that leave for use b=
efore the end of the leave year (i.e., for most employees, January 12, 20=
13), the leave will be forfeited. When “use or lose” leave i=
s forfeited under these conditions, the law does not permit restoration o=
f the leave. (See 5 U.S.C. 6304(d).)

The Pres=
ident’s Executive order excuses Federal employees from duty during =
a pay period in which multiple holidays fall within the same pay period. =
For further information on the procedures for multiple holidays during a=
pay period, see the attached questions and answers and the fact sheet &l=
dquo;Federal Holidays – Work Schedules and Pay” referenced above.
Employees of the U.S. Postal Service and contract employees sho=
uld contact their supervisor (or contract officer) to obtain information =
on their pay and leave entitlements for December 24th.

Thank you!

Not nearly an adequate phrase to properly communicate just how grate=
ful we are for the generosity of our passengers. This year’s Toys for Tot=
s yielded thousands of presents to be given to area children this holiday=
season that may not have otherwise gotten anything fun to play with.

=

Additional=
ly, thanks to you, we collected a total of $15,297.60 in cash, checks and=
gift cards onboard each morning train on Wednesday, December 5th for the=
Toys for Tots program.

While this is a major accomplishment, we’d like to recog=
nize the winners of the donations by line and train contest*:

We apologize for the delay and had hoped that by December 1st, we woul=
d have all the agreements in place in order to have the cost of the Step-=
Up Ticket reduced to $3. Unfortunately, when we put out that original est=
imated date in October, things have not panned out that way. There have b=
een communications since then stating we are pushing the date back and re=
gret that some riders did not get the message. Currently, we are still wa=
iting for the funding agreements to be finalized by the Commonwealth of V=
irginia. At this point, we hope to have all details in place by January 1=
st, but again, this is still an estimate. We will keep riders updated as =
new information becomes available.
